Mogadishu – In a bold move aimed at addressing and pressing need for constitutional reform that has been taken to Somalia, Somalia’s President Prof. Hassan Sheik Mohamud has taken drastic measures to initiate amendments to the country’s constitution. The President’s actions have sparked intense debate and raised concerns among political leaders, who were opposing the constitutional revision process.
The approved constitutional amendments, which include substantial changes to the power-sharing structure, and governance mechanisms, have drawn both support and criticism. Proponents argue that the amendments were necessary to address long-standing grievances, foster national reconciliation, and lay the foundation for a more inclusive and stable Somalia. Critics, however, express concerns over the potential impact on democratic principles and the rule of law.
One key provision in the approved draft establishes that Somalia will have a president and a prime minister. The president will hold the authority to appoint and remove the prime minister from office, an amendment that replaces the previous requirement for the prime minister to obtain a vote of confidence from parliament and allowing more flexibility in the executive branch.
Dr. Ahmed Ali, a constitutional expert and professor acknowledges the urgency for constitutional reforms in Somalia but emphasizes the importance of an inclusive and participatory process. he states, ” The president has taken positive measure While the need for constitutional amendments is evident, it is crucial to ensure that all relevant stakeholders are involved in the decision-making process. It is essential to engage civil society organizations, political parties, and marginalized groups to ensure a broad consensus and enhance the legitimacy of the amendments.”
Political leaders caution against hasty implementation and highlights the significance of adhering to established legal frameworks though consultations on the constitutional review process were conducted by the ministry of justice and constitutional affairs of the federal government of Somalia as well as debates in the parliament.
The Federal Parliament of Somalia have approved The Constitutional Amendment on 29th March 20224. A total of 212 members of the Lower House and 42 members of the Upper House supported the amendments, with no abstentions or rejections According to the speaker of the parliament.
“A total of 212 members of the Lower House and 42 members of the Upper House supported the amendments, with no abstentions or rejections. Therefore, the amendment has been approved with a unanimous vote,” said Madobe.
Ultimately, the success of Somalia’s constitutional amendments rests on the ability to strike a delicate balance between the need for drastic measures and the importance of upholding democratic principles. By engaging in an inclusive and participatory process, Somalia can lay the foundation for a more stable, inclusive, and prosperous future.
